Settlement Agreements

A Settlement Agreement is legally binding on an employee and employer and sets out agreed terms of settlement.  Once it has been signed pursuant to the relevant legal advice it prohibits an employee from taking what legal action he or she may have otherwise had against the employer. The signing of a Settlement Agreement is usually in exchange for a termination payment, details of which would be included in the contractual terms of settlement. A Settlement Agreement provides certainty between the parties and provides employees with an opportunity for a clean amicable break with their employer.  An employment reference is often negotiated as part of the terms of settlement, which is always helpful when seeking future employment elsewhere.  The terms also usually reflect the agreement between the parties to keep the settlement confidential and not to speak in a derogatory manner about the other.  In return, the employer is given assurance that any legal action which may have been taken against them is thereby waived by reason of binding settlement.
